Rental Agreement

Thank you for making your reservation with Dragonfly Dell Cottage, LLC. Please read the following policies carefully and call if you have any questions or concerns: (920) 890-0963. This agreement is between the signer/renter and Dragonfly Dell Cottage, LLC

IMPORTANT INFORMATION FOR YOUR VACATION:SHORT-TERM RENTAL AGREEMENT

THE PARTIES. This Short-Term Rental Agreement (“Agreement”) made on Booking Date between the following:

TENANT: (Name on Booking) (“Tenant”), and

OWNER: Dragonfly Dell Cottage, with a mailing address of 12465 Cedar Dell Lane, Ellison Bay, WI 54120. (“Owner”)

THE PREMISES. The owner agrees to lease the described property below to the Tenant, and the Tenant agrees to rent from the Owner:

Hereinafter known as the “Premises.”

RENTAL TERM. The Tenant shall have access to the Premises under the terms of this Agreement for the following time period:

Fixed Term/Check In-Check Out - The Tenant shall be allowed to occupy the Premises starting at 2:00 p.m. on the first date of their confirmed date of the stay and ending at 11:00 a.m. on the last date of their confirmed date of the stay. We can only consider requests for early check in or late check out depending on other guest bookings prior to or following your stay. If Tenant vacates later than approved, there will be an additional charge of $50.00.

RENT. The Tenant shall pay the Owner:

Fixed Amount. The Tenant shall be required to pay the Owner $475/night for the Lease Term (“Rent”). $25 additional per night for stays shorter than 3 nights.

PAYMENTS. Please follow the payment procedure you have received in your confirmation.

Reservation/Payments: Dragonfly Dell Cottage, LLC reserves the right to cancel your reservation if payment is not made within the timeline prescribed in the reservation confirmation. Personal checks, money orders, certified or cashier’s checks should be made payable to Dragonfly Dell Cottage.

Damage coverage: Tenant shall provide credit card information to Owner at time of booking to be kept on hand until Owner inspects Premises for damage and/or loss incurred during Tenant’s stay. No security deposit taken in advance.

Payment schedule and Cancellation policy: 50% of total stay due at time of booking. Remaining balance due 14 days before arrival. 100% of paid prepayments refundable when canceled 60 days before arrival or earlier. 50% of paid prepayments refundable when canceled 30 days before arrival or earlier. 25% of paid prepayments refundable when canceled 14 days before arrival or earlier. 0% refundable if canceled after.

Once payment and security requirements have been met, we will email you address, directions, and lock box code to the cottage. This procedure allows you to arrive to the property whenever you’d like to, as long as it is at or after your prescribed check in time.

Lock outs: If you get locked out of your rental during your stay, contact us by phone and we will arrange for a replacement key. Keys: There will be a $25 charge for any lost keys. One key will be in the lockbox when you arrive and it is expected to be left upon departure.

USE OF PREMISES. The Tenant shall use the Premises for residential use only. The Tenant is not authorized to sell products or services on the Premises or conduct any commercial activity. No off-road vehicles are allowed on the Premises. Tenant must stay within marked property boundaries.

QUIET HOURS. Quiet hours begin at 9:00 p.m. each night and continue until sunrise. Quiet hours consist of no music and keeping all audio at a minimum level out of respect for the surrounding residents. QUIET ENJOYMENT. The Tenant, along with neighbors, shall enjoy each other’s company in a quiet and respectful manner. The Tenant is expected to behave in a civilized manner and shall be good neighbors with any residents of the immediate area and be respectful of the natural surroundings and wildlife. Creating a disturbance of the area by large gatherings or parties shall be grounds for immediate termination of this Agreement.

OCCUPANTS. The maximum number of individuals staying on the Premises during the Rental Term shall be a total of 6 guests and is inclusive of adults & children. In cases involving infants, exceptions may be made to the maximum occupancy. Please keep visitors to a minimum. Events are not allowed. If more than the authorized number of guests listed above are found on the Premises, this Agreement will be subject to termination by the Owner.

ILLEGAL ACTIVITY. The Tenant shall use the Premises for legal purposes only. Any other such use that includes but is not limited to illicit drug use, verbal or physical abuse of any person or illegal sexual behavior shall cause immediate termination of this Agreement with no refund of pre-paid Rent. Fireworks, firearms, and all other weapons are STRICTLY PROHIBITED. STRICTLY PROHIBITED!

POSSESSIONS. Lost & Found Policy: Owner is not responsible for any items left behind at Premises. If you believe you have left something behind at the cottage, you may contact the Owner and they will attempt to locate the item. If located, Owner can return the item to you at your cost (minimum $15.00 charge for returned items). Items found and not reported lost within two weeks will be donated or disposed of.

PETS. Owner Does Not Allow Pets: There are no pets allowed on the Premises. If the Tenant is found to have pets on the Premises, this Agreement and any damages shall be forfeited.

PARKING. Two parking spaces are provided to the Tenant free of charge. Parking is limited to two vehicles at all times. Parking pads are located at the top and bottom of the driveway. There is a wagon at the top of the driveway to assist with luggage transfer for those not comfortable parking at the bottom of the drive. Tents, campers, or motor homes are not permitted on the premises. Any violations may result in eviction without reimbursement. NO RVs, ATVs, UTVs, Dirt-bikes, or “Slingshots” allowed on property.

PARTIES. Parties are strictly prohibited by the Owner. Failure to comply will result in termination of Agreement.

SMOKING POLICY. Smoking on the Premises is Prohibited. Smoking/vaping is strictly prohibited in the cottage. If it is determined that there was smoking in the Property the Tenant will be liable for all associated professional cleaning costs. Smoking is only allowed in the designated smoking area near the garage. Safe receptacles are provided and are expected to be used.

EMERGENCIES and OFFICE HOURS:

Dragonfly Dell Cottage management can be reached between 9 a.m. - 5:00PM daily. 920-890-0963. Emergencies can be called in at any time.

PERSON OF CONTACT. Owner does not have an agent/manager on the Premises, although the Owner/Maintenance contractor is nearby and can be contacted for any emergency, maintenance, or repair at:

SUBLETTING. The Tenant DOES NOT have the right to sublet the Premises.

ARRIVAL INSPECTION. Before, at the time of the Tenant accepting possession, or shortly thereafter, the Owner and Tenant shall inspect the Premises and write any present damages or needed repairs.

INSPECTION. The Owner has the right to inspect the Premises with prior notice as in accordance with State law. Should the Tenant violate any of the terms of this Agreement, the rental period shall be terminated immediately in accordance with State law. The Tenant waives all rights to process if they fail to vacate the premises upon termination of the rental period. The Tenant shall vacate the Premises at the expiration time and date of this agreement.

MAINTENANCE AND REPAIRS. The Tenant shall maintain the Premises in a good, clean, and ready-to-rent condition and use the Premises only in a careful and lawful manner. The Tenant shall leave the Premises in a ready to rent condition at the expiration of this Agreement, defined by the Owner as being immediately habitable by the next tenant. The Tenant shall pay for maintenance and repairs should the Premises be left in a lesser condition.

The Tenant agrees that the Owner shall charge Tenant for said services from if Tenant causes damage to the Premises or its furnishings.

DAMAGE: Tenant is responsible for missing or damaged items. If this situation shall arise, a charge will be made to your credit card. To avoid charges for prior damages, report any problems to management the day you check in.

TRASH. The Tenants shall dispose of all waste material generated during the Rental Term under the strict instruction and direction of the Owner.

OWNER’S LIABILITY: The Tenant and any of their guests hereby indemnify and hold harmless the Owner against any and all claims of personal injury or property damage or loss arising from the use of the Premises regardless of the nature of the accident, injury or loss. The Tenant expressly recognizes that any insurance for property damage or loss which the Owner may maintain on the property does not cover the personal property of Tenant and that Tenant should purchase their own insurance if such coverage is desired.

FIREPLACES & Firewood: Wood for fireplaces & the fire pit is provided in a limited supply. You may opt to purchase extra bundles from us or local suppliers. Please only buy firewood in Door County to help prevent the spread of invasive species of insects. NO fires are permitted in the living room. There is a designated fire pit outdoors, and a fireplace on the back porch.

There will be times during dry weather events when outdoor/fire pit burning will not be allowed. We will keep guests informed during these events and will have QR codes posted near the fireplace linking Tenants to DNR fire danger level information. Failure to comply will result in all renters’ immediate departure, without refund. Renter is responsible for any fines from Local/State Authorities.

ATTORNEY’S FEES. The Tenant agrees to pay all reasonable costs, attorney's fees, and expenses that shall be made or incurred by the Landlord enforcing this agreement.

During Your Stay:

FURNITURE: Do Not rearrange furniture. We are a family business, not movers. Furniture is arranged for safety and ease of use. Similarly, please clean the grill (if provided) after you use it or before you leave. Please wash the towels. We ask that by the time you leave, the last load of towels is in the dryer. Please wash, dry, and put away the dishes before you leave. Finally, please take out the trash and put it in the outdoor receptacles located near the garage. Owners will strip and wash bed linens.

TELEPHONE: Our cottage does not have a landline. Cell phone reception is strong for most carriers, but we do not yet have internet or wifi (coming soon).

Cable/Satellite, Internet, Air Conditioning are not provided. (When internet is provided at this property, please note that it is not intended for downloading of large files or illicit viewing. Any overuse or abuse of the internet will incur cost of overages and/or reinstatement fees.)

Repairs: Appliances, TVs, cable, internet, etc. can malfunction at any time and Dragonfly Dell Cottage is not able to guarantee all items will be in working order for the complete duration of your stay. All repairs and maintenance problems that may occur will be corrected as soon as possible. There are no reimbursements for minor problems or repairs that are fixed in a timely fashion. We reserve the right for our maintenance persons, and contracted repairpersons to enter the premises as needed during your rental stay for the purpose of repairs or general care & maintenance of the property. Dragonfly Dell Cottage will make a reasonable effort to notify renter when personnel are scheduled.

Acts of Nature/Construction Noise: Dragonfly Dell Cottage will not be held liable for events beyond our control that may affect renter’s occupancy, including but not limited to: Acts of Nature, acts of governmental agencies, fire, strikes, war, inclement weather (including flooding and power outages), and construction noise from nearby sites.

Well Water: Like most Door County properties, the cottage is supplied with well water. Some people do not find well water to be the most desirable. If this is the case, renters are responsible for their own drinking water. All the water is tested and is safe to drink.

Towels: We provide bath towels (a minimum of one set of towels per guest is provided; if more are desired, it is the guests’ responsibility to provide). Beach towels are not provided. Guests may not take bath towels out of the rental unit. When departing please collect all dirty towels and leave them in the laundry room downstairs. Lost or damaged towels will be deducted from the security deposit. Inventory of the towels will be taken upon your departure. $50 charge to the renters’ security deposit/credit card will be made for missing towels.

Linens: We provide linens. Please DO NOT wash sheets when checking out of property. Lost or damaged linens will be deducted from the security deposit.

Trash: All garbage is to be placed in receptacles located outside near the garage. In the event that upon departure the garbage receptacles are full, leave remaining garbage sealed in trash containers inside the rental unit. Do NOT leave garbage bags outside under ANY circumstance due to the likelihood of animals getting at it. If any garbage is left outside and is required to be cleaned up, there will be a $50 charge to your credit card.

Toilet Use: NO feminine products, pads, or diapers are to be flushed in the toilets at any time! Like many homes in Door County this cottage has a septic system that cannot process anything other than toilet paper; please assume anything other than toilet paper is foreign to the system. Receptacles will be in the bathrooms for proper disposal. Failure to comply could incur the actual cost of plumber and repair.

Accidents: Guest expressly agrees to indemnify and hold harmless Door County Property Management and property owners from any accidents, injuries, losses and/or damages to guests while on the property; including in the water, docks, shoreline, fire pits, or any other part or adjacent part of the property. This also includes any use of owners boats, kayaks, canoes, rafts, bicycles, etc., that are provided for the tenants use.

DEPATURE: Please turn off lights, fans, TVs, and appliances.

Please lock all doors and leave key securely locked in lock box.

GOVERNING LAW. This Agreement shall be governed and subject to the laws located in the jurisdiction of Premise’s location.

— I understand that my rental agreement expires at check out on the last day of my stay. I will check out, remove all my possessions and vacate the premises unless specific arrangements have been made with management. Dragonfly Dell Cottage/Owners are not responsible for any items left behind. I understand that if I leave early for any reason I am NOT entitled to a refund.

— I have read, and I agree to abide by these rules. I understand that violating these rules may result in eviction with no refund. I understand the cost of extraordinary cleaning, garbage removal, missing items, and damages may be deducted from my security deposit or charged to my credit card. I hereby authorize Dragonfly Dell Cottage management to keep my security deposit and/or charge my credit card for these violations.

— I understand that the terms and policies contained in this rental agreement supersede any conflicting advertising.
